Privacy statement when applying

1. General information

On submission of your job application documents to Circet Benelux (address: Jan van Rijswijcklaan 162/3, 2000 Antwerp, tel: +32 3 808 80 00) and its subsidiaries, hereinafter referred to as ‘Circet’, your personal data shall be kept and stored by Circet in an electronic database during the application period and 30 days after the application period has ended. The data shall be stored and transferred to third parties with a view to a possible conclusion of a contract of employment. Circet processes your data in the capacity of data controller.



2.  What data do we collect?

    Your basic identity data and your contact details that you give us, such as your name, photo, email address, telephone number, address, date of birth, nationality, etc.

  • Information you include in your CV, such as former and current employer, job description, work experience, education, qualifications and certificates, skills, references, interests, etc.

  • Any other information you give us in the context of your job application, such as information in your letter of motivation or that you would give during the interview.

  • Publicly available information on your public social media (e.g. on LinkedIn)

    

3. What do we use your data for and how long do we keep it?

Your job application data may be used to assess your suitability for advertised positions and other open positions. We may also pass on your personal data to subcontractors, partners and/or customers of Circet Benelux with whom we work if they have open positions that match your application profile. We shall only do this if you have ticked the consent box for this on submission of your application.

In the event of a spontaneous application and if we don't have any open positions that match your application profile, we'll request your consent to keep your personal data in our database for a period of 12 months for possible future positions and vacancies. This consent can be withdrawn in writing at any time. You can withdraw your consent by sending a message to vacature@circet.be or using the “withdraw consent” link in the confirmation mail of your application. Please note that in this case we will not be able to contact you for any interesting job opportunities in the future.

If the application is unsuccessful, Circet asks your consent to store the personal data you provided during the application procedure (e.g. in application letters, CVs, references, candidate questionnaires, interview notes and any (if applicable for the job you are applying for) assessments) even after the specific application procedure has ended. You give Circet Benelux permission to use these data to contact you at a later date, for a period of 12 months, and to continue the application procedure should you be considered for another position. As stated above, we may also share your data with our subcontractors, clients and/or third parties should your profile match an open position. We will seek separate consent for this.

We may also process your personal data in the context of a possible merger with, take-over of/by or demerger from said third party, even if said third party is located outside the EU. We will do this to pursue our legitimate interests and those of a third party, more specifically to be able to carry out normal business or merger and take-over transactions.

We process your personal data in pursuit of our legitimate interests and those of our partners if and to the extent that your application can be considered: (a) a violation of the applicable terms and conditions of use or the intellectual property or other rights of a third party; (b) a threat to the security or integrity of the job application webpage. (c) a danger to the webpage, our social media channels or any of our underlying systems or those of our subcontractors as a result of viruses, Trojan horse attacks, spyware, malware or any other form of malicious code; or (d) hateful, obscene, discriminatory, racist, defamatory, offensive in any way or containing otherwise inappropriate or illegal content.

We process your personal data to defend ourselves in the event of a dispute relating to your job application (e.g. in connection with a possible rejection of your application).

We process your personal data to comply with legal obligations or to fulfil a reasonable request from competent law enforcement officers or representatives, judicial authorities, government agencies or bodies, including competent data protection authorities. Your personal data may be transferred to the police or judicial authorities on our initiative as evidence or if there are well-founded suspicions of an unlawful act or crime committed by you. This constitutes an exceptional situation.



4. Who receives your personal data?

For the aforementioned purposes, we may share your personal data with other parties. Below we provide an overview of the parties who may have access to your personal data and receive them in the context of your application:

  • When you apply via the form on our job application webpage, your personal data and CV will be stored in our applicant platform.

  • When we receive your application via social media service providers, such as LinkedIn, said third parties will naturally also process your personal data. They do so as a separate data controller. We refer to the privacy statements of these third parties if you would like more information on how they process your personal data.   • We also work with IT service providers who manage and secure our website, for example. These processors may only process your personal data on our behalf based on our written instructions. It goes without saying that we guarantee that all external processors are selected with due care and that we will impose the necessary obligations on them to guarantee the security and integrity of your personal data.

If we transfer your personal data to third parties located outside the European Economic Area (the ‘EEA’ which includes the European Union, Liechtenstein, Norway and Iceland), we will implement adequate safeguards to ensure the security, confidentiality and integrity of your personal data. Such safeguards include an adequacy decision by the European Commission or concluding an agreement containing the standard clauses adopted by the European Commission.



5. Consent for inclusion in the database of applicants

Your consent is voluntary and does not affect your chances in the current job application process. You can choose not to give your consent without specification of reasons and without fearing any disadvantages. You can also withdraw your consent at any time; in this case your data will be deleted within seven days of our receiving your request. You can withdraw your consent by sending a message to vacature@circet.be or using the “withdraw consent” link in the confirmation mail of your application. Please note that in this case we will not be able to contact you for any interesting future vacancies.



6. Your rights

Circet Benelux values the security and confidentiality of your personal data. We wish to draw your attention to your rights, more specifically the right to information, the right of access, the right to rectification, the right to removal of your data, the right to restriction of processing, the right to data portability and the right to object.
